PFAS Upholstered Furniture Rules Spread Across US States

US state legislatures have kept up a steady flow of PFAS legislation through 2026. Roughly 100 bills were introduced in 17 states this session, with about 280 further bills carried over from 2025 across 23 states. Upholstered furniture and textile furnishings appear among the product categories under discussion.

Where upholstered furniture appears in the bills

Ohio's HB 743 would prohibit the sale of a list of specified products containing intentionally added PFAS, and that list includes upholstered furniture, textile furnishings, carpets, fabric treatments and juvenile products, with a proposed start date of 1 January 2028. Kentucky's HB 196 would require manufacturers of products sold in the state that contain intentionally added PFAS to report product and substance information, and would prohibit the sale of non-compliant products. Several other states are pursuing comparable consumer-product restrictions.

Why this reaches office seating

PFAS chemistry has historically been used in stain- and water-repellent finishes applied to contract upholstery. Office task chairs, soft seating, acoustic panels and meeting room chairs are routinely specified with such treatments, which means the fabric specification — not the frame — is where compliance questions usually surface. Because the rules are set state by state rather than nationally, exposure depends on where the goods are ultimately sold.

What buyers should do

• Ask suppliers to declare whether an intentionally added PFAS treatment is present on each upholstery option.

• Request a treatment-free alternative when the destination market restricts it, and check which of the two carries the lead time.

• Record the finish chemistry per SKU, so a state-level question can be answered without re-testing.

• Treat this as a moving target: with bills still moving through multiple legislatures, 2027 and 2028 delivery dates need to be revisited closer to the time.
